1. Agreement to Terms

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("User", "you"), and Kuldeep Kurre ("Developer", "we", "us", or "our"), regarding your access to and use of the One Sampark: Easy Chat & Add mobile application ("App") and website services at one-sampark.psdplace.com.

If you do not agree with all of these Terms and Conditions, you are expressly prohibited from using the App and must discontinue use and uninstall the application immediately.

2. Eligibility

By using One Sampark, you represent and warrant that:

• You are at least 13 years of age (or the legal age of majority in your jurisdiction).
• You have the legal capacity to enter into these Terms and agree to comply with all applicable local, state, national, and international laws.
• You will not access the application through automated or non-human means (such as bots or scrapers).

3. Description of Services & Functionality

One Sampark is an independent productivity utility designed to streamline messaging workflows and contact management. The App provides:

• Direct WhatsApp Chat Shortcuts: Generates standard public deep links (Click-to-Chat) allowing you to start a WhatsApp conversation with a recipient without first saving their number to your local device address book.
• Google Contacts Integration: Connects securely via Google OAuth 2.0 and Google People API to enable 1-tap addition of user-reviewed contact names and numbers directly to your personal Google Contacts.
• Smart Text Extraction: Automatically detects phone numbers and contact names from unformatted text, copied clipboard text, or conversational messages on-device in real-time.

4. User Conduct & Acceptable Use Policy

You agree to use One Sampark solely for legitimate, lawful, and personal or authorized professional communication. You expressly agree NOT to:

• Use the App to send unsolicited commercial electronic messages, mass marketing, spam, chain letters, or pyramid schemes in violation of telecommunication regulations (including TRAI regulations in India, CAN-SPAM, or TCPA).
• Harass, threaten, stalk, defraud, defame, or abuse any individual or entity through the communication links facilitated by the App.
• Attempt to reverse-engineer, decompile, disassemble, or derive the source code of the application binary.
• Bypass, modify, defeat, or circumvent any digital rights management, security controls, or API rate limits of third-party platforms (including WhatsApp and Google).
• Use the App for any fraudulent activity or impersonation of another person or business.

5. Accuracy of Contact Information

You acknowledge and agree that you are solely responsible for verifying the accuracy, identity, and country code of any telephone number before sending messages, making phone calls, or saving contacts. The Developer shall not be held liable for misdirected communications, erroneous messages, or calls made to incorrect recipients.

6. Intellectual Property Rights

Unless otherwise indicated, the One Sampark mobile application, including but not limited to source code, algorithms, graphic designs, user interface layouts, app icons, and branding elements, are the intellectual property of Kuldeep Kurre and are protected by copyright, trademark, and intellectual property laws.

You are granted a limited, revocable, non-exclusive, non-transferable license to download and install the App on your personal Android device solely for personal, non-commercial use in accordance with these Terms.

7. Third-Party Services, Trademarks & Disclaimers

One Sampark interacts with third-party software and external APIs. You acknowledge and accept the following third-party terms:

• WhatsApp & Meta Platforms: WhatsApp is a registered trademark of WhatsApp LLC and Meta Platforms, Inc. One Sampark is an independent utility and is NOT affiliated with, associated with, authorized by, sponsored by, or endorsed by WhatsApp LLC or Meta Platforms, Inc. The App merely invokes standard public URL schemes (https://wa.me/) supported by the WhatsApp client.
• Google LLC & Google Contacts: Google, Google Play, Android, Google Contacts, and Google People API are trademarks of Google LLC. One Sampark's access to Google services is governed by the Google API Services User Data Policy.
• Google AdMob: Advertisements shown within the application are served by Google AdMob. Third-party advertisers may collect pseudonymous device identifiers. We do not control or endorse the content of third-party advertisements.

8. Privacy Policy

Your privacy is of utmost importance to us. Please review our comprehensive Privacy Policy, which explains how we handle Google authentication and contact data, and confirms that we do not store your contacts on external servers. By using the App, you consent to our Privacy Policy.

9. Modifications to the App & Services

We reserve the right, at our sole discretion, to modify, update, suspend, or discontinue any feature, functionality, or part of One Sampark at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THE DEVELOPER MAKES NO WARRANTY THAT (A) THE APP WILL MEET YOUR REQUIREMENTS, (B) THE OPERATION OF THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR (C) THIRD-PARTY SERVICES (SUCH AS WHATSAPP CLICK-TO-CHAT OR GOOGLE PEOPLE API) WILL REMAIN COMPATIBLE OR UNALTERED OVER TIME.

11. Limitation of Liability

IN NO EVENT SHALL THE DEVELOPER (KULDEEP KURRE) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING LOSS OF PROFITS, DATA LOSS, DEVICE DAMAGE, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE APP IS TO UNINSTALL AND DISCONTINUE USING IT.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your access to or misuse of the App, (b) your violation of these Terms, or (c) your infringement of any third-party rights or laws.

13. Governing Law & Jurisdiction

These Terms and Conditions and your use of One Sampark shall be governed by and construed in accordance with the substantive laws of India, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts located in Chhattisgarh, India.

14. Severability & Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. These Terms and our Privacy Policy constitute the entire agreement between you and the Developer concerning the App.
